Job Details
AmTrust has an immedidate need for a Legal Advisor III in our Claims department. This poistion will be based out of our Irvine, CA office. This role will report to the Managing Attorney. The overall goal and responsibility of this role is to seek resolution of workers' compensation cases in the most efficient manner possible and on terms most fair to AmTrust and its insured.
ResponsibilitiesResponsible for the following aspects of file handling:
- initial file reviews,
- crafting plans of action for case resolution,
- communication with Claims concerning case status/exposure,
- communication with opposing counsel,
- management of all phases of medical-legal discovery,
- records review and summary, routine legal filings (Petitions to Dismiss, Petitions to Compel, DORs etc),
- case settlement via Compromise and Release or a Stipulation with request for Award.
The Legal Advisor shall attend and represent AmTrust at hearings before the WCAB, subject to the determination of Managing Counsel that the Hearing Advisors skills and experience are appropriate for the subject hearing(s). These hearings will predominantly include Status Conferences, Rating MSCs, and MSCs. The Legal Hearing may also represent AmTrusts interests at Expedited Hearing or Trial, but only with direct in-hearing supervision by Managing Counsel or Staff Counsel. The Legal Advisor will also be asked to take basic applicant depositions.
Qualifications- 7+ years of experience as a Hearing Representative
- Experience with Workers Compensation (laws and regualtions)
- College Degree is required
- Ability to make quick and fair decisions that is fair to both AmTrust and its isured
- Ability to attend medidations and/or trials or expedited hearings
