Litigation Attorney, Asbestos Legal Group

Purpose and Importance of Position

This position is primarily responsible for (i) directing and resolving asbestos-related insurance coverage litigation involving insurance carriers on whose behalf RiverStone Claims Management LLC handles claims (RiverStone insurers); (ii) analyzing and managing the most complex and high exposure asbestos-related insurance coverage issues affecting RiverStone insurers; (iii) providing legal advice on the most complex and high exposure legal issues facing RiverStone insurers, both within and outside the context of pending insurance coverage litigation; and (iv) leading strategic business and/or legal initiatives on behalf of RiverStone insurers.

Essential Functions

  • Handles the most complex and high-exposure asbestos-related insurance coverage litigation
  • Manages assigned insurance coverage litigation and seeks to resolve such litigation on commercially reasonable terms
  • Retains outside counsel with approval of upper management as needed and manages outside counsel as collaborative partners who assist in the management and resolution of asbestos-related exposures and insurance coverage litigation
  • Develops valuation models and develops and implements settlement strategies
  • Leads settlement negotiations
  • Reviews, revises (as needed) and approves pleadings, discovery, motions and briefs
  • Identifies and assists in the preparation of RiverStone insurers corporate witnesses and employees who testify as fact witnesses
  • Directs preparations for trial (largely through outside counsel), including (i) oral and documentary evidence (including witnesses and trial graphics and demonstrative exhibits), (ii) trial themes and strategies, (iii) consideration of trial consultants and mock trials, and (iv) a pre-trial report and pre-trial strategy meetings with counsel and management no later than 90 days before trial
  • Researches, evaluates and approves the retention of expert witnesses
  • With outside counsel, develops reasonable and appropriate litigation plans and budgets
  • Analyzes facts, policy language, law and exposures and develops litigation and resolution strategies concerning asbestos-related exposures
  • Serves as subject matter lead on assigned asbestos-related legal issues, developing an in-depth knowledge of the legal issues, facts, policy language and law
  • Assists in developing and maintaining consistent positions on key asbestos-related legal issues
  • Reviews, adjusts (as needed) and approves payment of invoices to ensure that reasonable and necessary legal fees and expenses are timely paid
  • Leads or otherwise participates in strategic business or legal initiatives
  • Tracks assigned industry trends and legal developments that may materially impact RiverStone insurers
  • Provides legal advice on the most complex and high exposure legal issues facing RiverStone insurers both within and outside the context of insurance coverage litigation
  • Trains associates on key legal issues
  • Serves as project leader, as needed
  • Leads or otherwise participates in acquisitions activity, including due diligence and transition activities, as needed
  • Develops and maintains productive, positive, professional relationships with other associates and outside counsel
  • Strives to consistently provide the utmost customer service to all RiverStone associates

Experience

Minimum of 10-15 years of complex insurance litigation experience, whether as outside counsel or through employment in the insurance industry.

Required Education

Juris Doctorate and admission to a state bar

Supervisory Role

The Attorney, Asbestos Legal Group directs the work of outside counsel, other vendors, paralegals and other support staff who assist on assigned work matters subject to existing standards, protocols and practices within the Legal Department.

Travel

Infrequent travel, depending on demands of assignments, mostly domestic, but occasionally international.
